Definitions and Interpretation

In these Terms & Conditions, the following definitions apply unless the context requires otherwise:

• "by99", "we", "us", "our" refers to the by99 platform and its operating entity, accessible at https://by99.io.
• "Player", "you", "your" refers to any individual who registers for or accesses a by99 account.
• "Platform" refers to the by99 website, mobile-optimised interface, and all associated services including casino games, sports betting, and the by99 cashier.
• "Account" refers to the registered player account created on the by99 Platform following successful completion of the registration process.
• "BDT" refers to Bangladeshi Taka, the currency used for all transactions on by99.
• "Bonus Funds" refers to promotional credits awarded by by99 that are subject to wagering requirements before they may be withdrawn.
• "Real Money Funds" refers to deposits made by the player via bKash, Nagad, Rocket, Upay, or other accepted payment methods.

References to the singular include the plural and vice versa. Section headings are for convenience only and do not affect interpretation.

Acceptance of Terms

By accessing the by99 Platform, creating an account, making a deposit, or placing any wager, you confirm that you have read these Terms & Conditions in their entirety and agree to be legally bound by them. If you do not agree to any provision of these Terms & Conditions, you must immediately cease use of the by99 Platform and close your account.

These Terms & Conditions are supplemented by the by99 Privacy Policy and Responsible Gaming Policy, both of which are incorporated by reference and form part of the overall agreement between you and by99. In the event of any conflict between these Terms & Conditions and any promotional materials, these Terms & Conditions shall prevail.

Eligibility and Account Registration

Access to the by99 Platform is strictly limited to individuals who meet all of the following eligibility criteria:

• You are at least 21 years of age. by99 enforces a strict 21+ age requirement on all accounts and products. Players under 21 are not permitted to register, deposit, or participate in any game or betting activity on by99.

During registration, you are required to provide accurate, current, and complete information including your full legal name, date of birth, valid email address, and a Bangladeshi mobile number. by99 reserves the right to request supporting identity documents at any time as part of its KYC process. Providing false, misleading, or incomplete registration information constitutes a material breach of these Terms & Conditions and may result in immediate account suspension and forfeiture of any balance held.

Account Security and Responsibility

You are solely responsible for maintaining the confidentiality of your by99 account credentials, including your username, password, and any two-factor authentication codes associated with your account. by99 strongly recommends enabling two-factor authentication via your registered Bangladeshi mobile number to provide an additional layer of account protection.

You agree not to share your account credentials with any third party, permit any third party to access or use your account, or use any third party's account. Any activity conducted through your account — including all deposits, wagers, and withdrawals — is your sole responsibility, whether or not that activity was authorised by you.

If you suspect that your account credentials have been compromised or that your account has been accessed without authorisation, you must notify by99 support immediately at [email protected]. by99 cannot be held liable for losses arising from unauthorised account access where the player failed to maintain adequate credential security or failed to notify by99 promptly upon discovering a breach.

by99 employs 256-bit SSL encryption across all Platform connections and monitors accounts continuously for unusual activity. Accounts displaying patterns consistent with fraud, collusion, or unauthorised access may be temporarily suspended pending investigation without prior notice.

Deposits, Withdrawals, and Payments

All transactions on the by99 Platform are conducted in Bangladeshi Taka (BDT). by99 accepts deposits and processes withdrawals via the following payment methods: bKash, Nagad, Rocket, Upay, Dutch-Bangla Bank, BRAC Bank, and major international card networks including Visa and Mastercard. Available methods may vary and are subject to change without prior notice.

Deposits: The minimum deposit amount is ৳500. Deposits are credited to your by99 account balance upon confirmation from the payment provider. by99 does not charge any processing fee on standard deposits; however, your payment provider may apply its own transaction fees, for which by99 accepts no responsibility.

Withdrawals: Withdrawal requests are processed in the order they are received during Bangladesh Standard Time (BST, UTC+6) business hours. Standard processing time is 1–4 hours. VIP Gold, Platinum, and Black Diamond tier members receive expedited processing as a standard tier benefit. The minimum withdrawal amount is ৳1,000. by99 reserves the right to request KYC documentation before processing any withdrawal. Withdrawal requests will only be processed to a payment method registered in the account holder's own name.

Verification of Funds: by99 does not accept deposits sourced from illegal activity. By making a deposit, you confirm that all funds used are from legitimate sources and that you are the authorised holder of the payment method used.

Bonuses and Promotional Offers

by99 may offer bonuses, free spins, cashback promotions, reload bonuses, and other promotional incentives from time to time. All bonuses are subject to the specific terms published at the time the promotion is offered, which are incorporated into and form part of these Terms & Conditions.

Unless a specific promotion states otherwise, the following general bonus conditions apply:

• All bonuses are subject to wagering requirements that must be met in full before any Bonus Funds or associated winnings may be withdrawn.
• Wagering requirements are calculated on the total Bonus Funds amount unless stated otherwise in the specific promotion terms.
• Bonuses are valid for the period stated in the promotion. Unclaimed or unused bonuses expire at the end of the validity period.
• by99 reserves the right to withdraw any bonus offer at any time and to amend bonus terms with reasonable notice.
• Bonuses may only be claimed once per player, household, IP address, or device unless a promotion explicitly states otherwise.
• Attempting to claim a bonus in bad faith, through the use of multiple accounts, or through any form of abuse will result in forfeiture of the bonus and associated winnings, and may result in account closure.

by99 reserves the right to withhold or reverse any bonus or associated winnings where it determines, in its reasonable discretion, that a bonus has been claimed or used in a manner inconsistent with these Terms & Conditions or the specific promotion terms.

Game Rules and Fair Play

All casino games available on the by99 Platform — including video slots, live dealer tables, crash games, virtual sports, and table games — are provided by certified third-party game studios including Pragmatic Play, Evolution Gaming, Ezugi, NetEnt, Microgaming, Play'n GO, Spribe, and other authorised providers. Sports Betting Rules

by99 offers pre-match and live in-play sports betting markets covering cricket (including the Bangladesh Premier League, T20 World Cup, and IPL), football, kabaddi, and more than 30 other sports. All sports betting activity on the by99 Platform is subject to the following rules in addition to any market-specific rules published at the time of betting.

• Bet Acceptance: All bets are accepted at the odds displayed at the time the bet is confirmed. by99 reserves the right to refuse or limit any bet at its discretion.
• Void Bets: A bet will be declared void if the event is cancelled, abandoned, or postponed beyond the period specified for the relevant market. Voided bets are refunded to the player's account balance at the original stake amount.
• Live Betting: In-play betting markets may be suspended at any time during a live event. Bets placed before a suspension is applied are honoured; bets placed after a suspension are void.
• Minimum and Maximum Stakes: Minimum and maximum stake limits apply per market and are displayed at the time of bet placement. These limits may be adjusted without prior notice.
• Obvious Errors: In the event that odds are published due to a manifest error, by99 reserves the right to void any bets placed at those erroneous odds and to correct the market.
• Results: Official results as declared by the relevant governing body (e.g., ICC for cricket, FIFA for football) are used to settle all markets. by99's decision on result settlement is final.

Responsible Gaming

• Self-Exclusion: Permanently exclude yourself from the by99 Platform. Self-exclusion requests are processed within 24 hours. Once self-excluded, a player may not re-register for a minimum period of 6 months.

The by99 Platform is strictly restricted to players aged 21 and above. by99 actively enforces this requirement through KYC verification and will immediately close any account found to belong to a person under the age of 21, with all associated funds returned to the depositing payment method where verification permits.

Prohibited Conduct

The following conduct is strictly prohibited on the by99 Platform. Engaging in any of the following activities constitutes a material breach of these Terms & Conditions and will result in immediate account suspension, forfeiture of account balance, and may result in legal action:

• Registering or operating more than one account on the by99 Platform.
• Providing false, inaccurate, or misleading registration or KYC information.
• Using the by99 Platform if you are under 21 years of age.
• Using automated software, bots, scripts, or artificial intelligence tools to interact with the Platform in any way that provides an unfair advantage or circumvents normal gameplay.
• Engaging in collusion, chip-dumping, match-fixing, or any form of coordinated cheating in casino games or sports betting markets.
• Depositing funds sourced from illegal activity or attempting to use the by99 cashier for any purpose related to money laundering.
• Attempting to reverse-engineer, decompile, hack, or otherwise gain unauthorised access to any part of the by99 Platform, its software, or its databases.
• Claiming bonuses in bad faith, through multiple accounts, or through any technique designed to circumvent bonus eligibility rules.
• Engaging in any conduct that is abusive, threatening, or harassing towards by99 staff or other players.
• Using a VPN, proxy, or other IP masking technology to circumvent geographic restrictions or Platform security measures.

Intellectual Property

All content on the by99 Platform — including but not limited to the by99 brand name and logo, website design and layout, text, graphics, game interfaces, software, data compilations, and all other materials — is the exclusive intellectual property of by99 or its licensed content providers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the by99 Platform solely for your personal entertainment in accordance with these Terms & Conditions. No rights of ownership or sub-licencing are granted. You may not copy, reproduce, distribute, modify, adapt, create derivative works from, publicly display, or commercially exploit any content from the by99 Platform without the express prior written consent of by99.

Limitation of Liability

To the maximum extent permitted by applicable law, by99 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of winnings, loss of data, loss of goodwill, or business interruption.

by99 makes no warranty that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. Scheduled maintenance, unscheduled downtime, and third-party service interruptions (including those affecting bKash, Nagad, Rocket, or other payment partners) are outside the direct control of by99, and by99 accepts no liability for losses arising from such events.

In no event shall by99's total aggregate liability to any individual player exceed the total amount deposited by that player into their by99 account in the 30 days immediately preceding the event giving rise to the claim.

Amendments to Terms

by99 reserves the right to amend, update, or replace these Terms & Conditions at any time. When material changes are made, by99 will notify registered players by email to the address on file and/or by displaying a prominent notice on the Platform. The effective date of the revised terms will be clearly stated at the top of the updated document.
